Manila: The Senate impeachment court has directed House prosecutors to keep their cases open concerning Vice President Sara Duterte's confidential fund and grave threat charges. This decision leaves room for senator-judges to potentially call additional witnesses.
According to Philippines News Agency, presiding officer Francis 'Chiz' Escudero stated the court would decide on the necessity of further testimony after both the prosecution and defense have presented their main evidence. This directive pertains to Article I, which involves Duterte's alleged misuse of PHP612.5 million in confidential funds, and Article IV, which concerns her alleged threats against President Ferdinand R. Marcos Jr., First Lady Liza Araneta-Marcos, and former House Speaker Martin Romualdez.
Escudero mentioned that several senator-judges have considered summoning Col. Raymund Dante Lachica and Col. Dennis Nolasco, who have been repeatedly mentioned in testimonies regarding the confidential funds but were not presented by the prosecution. The court is poised to use its discretion to call or recall witnesses if deemed necessary to clarify facts or issues within the proceedings, which are considered 'sui generis.'
Should the court decide to call Lachica, Nolasco, or other witnesses, both prosecution and defense will be allowed to cross-examine them and present subsequent rebuttal evidence. Escudero emphasized the importance of due process, ensuring both parties have the opportunity to question any court-called witnesses.
House lead prosecutor Rep. Gerville Luistro complied with the court's directive, acknowledging the ruling to keep the cases open. The prosecution had previously argued that existing testimony was sufficient to support their allegations regarding the confidential funds, without needing further witnesses.
Defense lead counsel Sheila Sison expressed the defense's respect for the court's ruling while reserving their stance on the order. Escudero noted that any reservations would not affect the formal offer of evidence, which would occur after the prosecution has presented its case on all articles.
