No Work, No Pay Policy to Apply on October 31, Says DOLE

Manila: The Department of Labor and Employment (DOLE) announced that the “no work, no pay” policy will be in effect on October 31, which has been designated as a special non-working day.

According to Philippines News Agency, the labor advisory issued by DOLE specifies that workers who choose not to work on October 31 will not receive their salary for that day, unless their company has a favorable policy, practice, or a collective bargaining agreement that provides payment on a special day.

Employees who do work on this day are entitled to an additional 30 percent of their daily wage for the first eight hours. The DOLE outlined this in their advisory, stating, “For work done during the special day, the employer shall pay the employee an additional 30 percent of the basic wage on the first eight hours of work (basic wage x 130 percent).”

Furthermore, employees who work beyond eight hours will receive an additional 30 percent of the hourly rate for the extra hours worked. The advisory explains, “If the employee works in excess of eight hours, the employer shall compensate the employee with an additional 30 percent of the hourly rate on this day (hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked).”

For employees whose work on October 31 coincides with their rest day, the company is required to pay an additional 50 percent of the basic wage for the first eight hours of work. Additionally, for any hours worked beyond eight on the rest day, an additional 30 percent of the hourly rate will be applied.

This special non-working holiday has been declared nationwide following President Ferdinand Marcos Jr.’s Proclamation No. 727.
