Manila: Lead prosecutor and Batangas Rep. Gerville 'Jinky Bitrics' Luistro on Tuesday emphasized the need for accuracy in the language used by prosecutors during the impeachment trial of Vice President Sara Duterte, asserting that they must effectively represent the Filipino people. This statement came after the defense counsel challenged the use of strong language by prosecutor lawyer Mae Divinagracia during her direct examination of Office of Vice President (OVP) Assistant Secretary Lemuel Ortonio on Day 18 of the trial.
According to Philippines News Agency, the defense requested the impeachment court to advise prosecutors to refrain from using terms like 'scam,' 'mastermind,' and 'nagsisinungaling (lying).' Presiding officer Sen. Francis 'Chiz' Escudero supported the need for caution with strong statements, while Senator-judge Alan Peter Cayetano highlighted that charged words could gain traction outside the courtroom.
Luistro, in a press briefing, expressed respect and compliance with the impeachment court's guidance, recognizing the Senate's authority. However, she underscored the necessity for the prosecution to communicate clearly and accurately, especially when discussing matters involving public funds, audit findings, and alleged irregularities in the use of confidential funds.
She elaborated that accuracy necessitates using language that precisely mirrors the evidence and testimony. During Divinagracia's examination, questions were raised about the OVP's confidential fund requests, disbursement vouchers, liquidation documents, audit responses, certifications, medical and food assistance, and the alleged absence of receipts and inconsistent explanations regarding the funds.
Luistro acknowledged Divinagracia's passion during the proceedings but reiterated the mandate for accuracy in communication, not only to the senator-judges but also to the Filipino people, whom the prosecution team represents. She highlighted that the impeachment trial transcends a simple dispute, encompassing public accountability and the people's interest in understanding the handling of confidential funds.
Luistro affirmed the prosecution's commitment to adhere to the court's directives on language use in the courtroom. The House prosecution team plans to continue presenting its case under Article I, which accuses Duterte of systematic misuse, misappropriation, and irregular liquidation of the OVP's confidential funds.
