DOJ Approves Use of Immigration Certificates for Birth Reporting

Manila: The Department of Justice has clarified the use of Bureau of Immigration-issued identification certificates in reports of birth applications. The clarification comes as part of an effort to streamline the process for individuals seeking recognition of their Philippine citizenship in various administrative processes.

According to Philippines News Agency, the DOJ, through Legal Opinion No. 11, series of 2026, declared that the Identification Certificate issued by the Bureau of Immigration, which pertains to the Recognition of Philippine citizenship, is a sufficient basis for processing a Report of Birth (ROB) application. This opinion was issued on April 16, 2026, and was signed by Justice Secretary Frederick Vida.

The legal opinion was a response to an inquiry from the Department of Foreign Affairs, specifically through the Office of Undersecretary Jesus Domingo for Civilian Security and Consular Affairs. The inquiry sought clarification on whether the BI-issued Identification Certificate recognizing Philippine citizenship could be used by a Philippine consulate to process an ROB application for individuals whose parents had acquired foreign citizenship before the applicant's birth and later re-acquired Philippine citizenship under Republic Act 9225.

The opinion detailed that Section 4 of RA 9225 restricts derivative citizenship to unmarried legitimate, illegitimate, or adopted children below 18 years of age whose parents have re-acquired Philippine citizenship. For children who are 18 years old and above at the time of their parents' re-acquisition of Philippine citizenship, recognition proceedings before the Bureau of Immigration are necessary for them to be considered Philippine citizens.

The opinion further explained that RA 9225 allows natural-born Filipinos, who have become naturalized citizens of another country, to retain or reacquire Philippine citizenship by taking the prescribed oath of allegiance. Justice Secretary Vida emphasized that acquiring Filipino citizenship must be based on legal principles rather than convenience or presumption.
